These Terms apply to The Next Step Toolkit and any other consumer digital product expressly sold under these Terms by Niamh Ramachandran trading as Rising Pathways Coaching through risingpathwayscoaching.co.uk and/or the Rising Pathways Payhip checkout.Please read these Terms carefully before placing an order and keep a copy for your records.By placing an order, you agree to these Terms. These Terms apply to your purchase together with any product description, checkout information and other document expressly referred to in them.

2. Service availability
Our paid Digital Products are currently available only to people resident in the United Kingdom. We do not accept orders from customers resident outside the United Kingdom.
3. Your status
By placing an order, you confirm that:• you are legally capable of entering into a binding contract;• you are at least 18 years old;• you are resident in the United Kingdom; and• you are purchasing the Digital Product as a consumer.
4. How the contract is formed
Your order is accepted and the contract between us is formed when your payment is successfully completed through Payhip.After successful payment, Payhip will provide access to the Digital Product and will send you an email receipt containing details of your purchase and a link to access or download the Digital Product.The contract relates only to the Digital Product or Digital Products identified in the order confirmation or receipt.
4.1 Consumer cancellation rights and immediate digital supply
If you are purchasing as a consumer, you normally have the right to cancel a distance contract within 14 days of the date the contract is formed.The Next Step Toolkit is intended to be supplied immediately after purchase. Before immediate supply begins, you must expressly consent to the Digital Product being supplied before the end of the 14-day cancellation period and acknowledge that you will lose your statutory right to cancel in relation to that Digital Product once supply begins.Where the required express consent and acknowledgement have been obtained and immediate digital supply has begun, you will no longer have the 14-day change-of-mind cancellation right for that Digital Product.If a statutory cancellation right still applies, you may cancel by emailing [email protected] or by using the model cancellation form at Annex 1.To meet the deadline, it is sufficient to send your cancellation communication before the cancellation period expires.
5. Availability and delivery
The Next Step Toolkit is a one-off downloadable PDF Digital Product.It is not a subscription, membership or recurring-access product.The Digital Product is intended to be made available automatically through Payhip after successful payment. If the download or access link is not made available, please contact [email protected].The Next Step Toolkit requires a device and software capable of opening PDF files.
6. Intellectual property and personal-use licence
You are entitled to use the Digital Product once we have received full payment of the sums due for it.
Subject to any third-party rights, Niamh Ramachandran trading as Rising Pathways Coaching is the owner or licensee of the intellectual property rights in the Digital Product and its original content.You receive a personal, non-exclusive, non-transferable, revocable licence to download, view, store and print the Digital Product for your own personal and non-commercial use.You must not reproduce, sell, share, distribute, upload, republish, licence, teach from, commercially adapt or otherwise make the Digital Product available to another person or organisation without our prior written permission.Where the Digital Product contains third-party material, ownership remains with the relevant third-party rights holder and use is subject to any applicable third-party licence or permission.
6.1 Content disclaimer
The Next Step Toolkit is a self-guided resource provided for personal reflection, education and general information. It is not therapy, counselling, medical or psychological advice, legal advice, financial advice, employment advice or crisis support.Purchasing, downloading or using the Toolkit does not create a coach-client relationship with Rising Pathways Coaching.You remain responsible for your own decisions and actions and should seek appropriately qualified professional support where required.
7. Price and payment
The current net price of The Next Step Toolkit is £29 excluding VAT. Where VAT applies, it will be added to the price and the total amount payable will be shown before you complete your purchase.Payment must be made using one of the payment methods made available through the Payhip checkout at the time of purchase.
Prices may change for future purchases.A price change will not affect a contract already formed with you.
8. Refunds and statutory rights
Once immediate supply of the Digital Product has begun following your express consent and acknowledgement, you will lose your statutory right to cancel simply because you change your mind.Nothing in these Terms affects your statutory rights.If the Digital Product does not conform to the contract, any remedies available to you under applicable consumer law remain available, including where the Digital Product is not of satisfactory quality, not fit for a particular purpose made known to us, or not as described.Where a refund is due, we will normally refund the money using the same payment method originally used for the purchase, unless another method is agreed or required.
9. Our liability
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.Nothing in these Terms affects your statutory rights as a consumer. In particular, we do not exclude or limit our responsibility where The Next Step Toolkit does not meet the standards required by applicable consumer law, including where it is not of satisfactory quality, not fit for a particular purpose made known to us, or not as described.The Next Step Toolkit is a self-guided resource for general information, education and personal reflection.It is not individual professional advice and we are not responsible for losses arising solely from decisions you make in reliance on the Toolkit where the content has been supplied in accordance with these Terms and we have not breached any legal duty owed to you.We will not be responsible for losses that were not reasonably foreseeable when the contract was made or that result from matters outside our reasonable control, except where the law requires otherwise.These Terms do not exclude or restrict any remedy available to you under applicable consumer law.
10. Written communications
Our communications with you will mainly be electronic, including by email and through information provided during the Payhip checkout or order process.Nothing in this clause affects your statutory rights.
11. Notices
Notices to Rising Pathways Coaching may be sent to [email protected] or to Niamh Ramachandran trading as Rising Pathways Coaching, 95 Younghayes Road, Cranbrook, Exeter EX5 7DR.

12. Transfer of rights and obligations
You may not transfer your rights under this contract to another person without our prior written consent.We may transfer our rights and obligations under this contract only where doing so does not reduce the protections or benefits you are entitled to under these Terms or applicable consumer law.
13. Events outside our control
We will not be responsible for any failure or delay in performing our obligations where this is caused by circumstances outside our reasonable control. If such circumstances materially affect our ability to supply the Digital Product, we will take reasonable steps to resolve the issue and, where appropriate, provide the Digital Product as soon as reasonably possible. Nothing in this clause affects your statutory rights.
14. Waiver
If either of us does not insist immediately on the other complying with an obligation under these Terms, or delays in enforcing a right or remedy, that does not mean the obligation no longer applies or that the right or remedy has been waived.
A waiver of a particular breach does not waive any later breach. Any express waiver must be communicated in writing.
15. Severability
If any provision of these Terms is found by a competent authority to be invalid, unlawful or unenforceable, that provision will be treated as removed or limited to the extent necessary and the remaining provisions will continue in effect.
16. Entire agreement
These Terms, together with any document expressly referred to in them, set out the agreement between us in relation to the Digital Product.Nothing in this clause limits any rights you may have under consumer law or any responsibility we may have for fraudulent or misleading statements.
17. Changes to these Terms
We may update these Terms from time to time for future purchases. Any changes will not affect a contract already formed with you unless the change is required by law or is necessary to correct an obvious error and does not materially disadvantage you.
18. Law and jurisdiction
These Terms and any contract for the purchase of a Digital Product are governed by the law of England and Wales.
If you are a consumer, you will also benefit from any mandatory protections available to you under applicable consumer law.Nothing in these Terms affects any right you may have to bring proceedings in the courts of the part of the United Kingdom in which you live.
ANNEX 1 - MODEL CANCELLATION FORMUse this form only if you are a consumer and a statutory cancellation right still applies.
Where you have expressly consented to immediate digital supply, acknowledged the loss of the 14-day cancellation right, and supply has begun, the change-of-mind cancellation right for that Digital Product may already have been lost.To:
